The terms that apply to drivers and delivery partners

Driver Terms and Conditions

These terms apply to every driver who registers to carry out deliveries through Surplus GY, whether working independently or through a registered delivery company. Please read them before you accept your first job. By registering as a driver, you agree to them.

Surplus GY.com Inc. is referred to below as "Surplus GY", "we" or "us". "You" means the driver.

1. Who can drive

To carry out deliveries through the platform you must be at least eighteen years old and legally entitled to work in Guyana. You must hold a current driving licence valid for the class of vehicle you intend to use, and the vehicle must be roadworthy, correctly registered and insured for the carriage of goods.

You must provide the documents we ask for during registration, and you must keep them current. If a document expires, your account is suspended until a valid replacement is accepted. We may decline or withdraw an approval where a document cannot be verified.

2. Your relationship with us

You are an independent contractor. You are not an employee, worker, partner or agent of Surplus GY, and nothing in these terms creates an employment relationship. You decide whether to make yourself available, and you decide whether to accept any particular job.

Because you are self-employed, you are responsible for your own tax and national insurance, for your own vehicle costs including fuel, maintenance and insurance, and for any licence or permit your work requires. We do not deduct tax from your earnings.

If you drive for a registered delivery company on the platform, your relationship with that company is a matter between you and them. Your earnings are paid to the company, and the company is responsible for paying you.

3. Accepting and carrying out jobs

When a job is offered to you, you may accept or decline it. Once you accept, you are responsible for completing it, and for telling us promptly through the app if you cannot.

You agree to collect and deliver items with reasonable care, to follow any handling instruction attached to a job, and to complete the confirmation steps the app asks for, which may include a delivery photograph, a signature, or a code given to you by the customer. Those steps are how a delivery is proven, so a job is not complete until they are done.

You must not open, use, tamper with, or allow anyone else to handle an item you are carrying. You must not carry an item you believe to be prohibited, unsafe or illegal, and you must tell us if you are asked to.

You must obey the road traffic laws of Guyana at all times. You must not use the app while driving. If you are involved in an accident while carrying an item, tell us as soon as it is safe to do so.

4. Location and the app

While you are on an active delivery, the app shares your location with us. This is how a customer follows their delivery, how we confirm a collection or delivery took place, and how a job is matched to a nearby driver. Location is collected while a job is running, and you can stop it by going offline in the app when you are not working.

Your account is personal to you. You must not share your login, let anyone else carry out a job assigned to you, or run the app on a device you do not control.

5. Payment

Your pay for a job is shown before you accept it, or is confirmed when the fare is finalised where a job is priced on distance. Payment is calculated on the rate card in force at the time of the job, less the platform commission that applies to your account type.

Earnings are paid to the account you register with us, on the payment schedule published in the driver dashboard. It is your responsibility to keep those account details correct; we are not liable for a payment sent to details you gave us in error.

Where a job is cancelled after you have set out, or where you arrive and the customer is not available, the compensation shown in the app for that situation applies.

If an item is lost or damaged while in your care, we may withhold or recover the value of the affected job. Where a dispute arises, we will tell you what has been claimed and give you a fair opportunity to respond before anything is withheld.

6. Standards and conduct

You agree to behave courteously and professionally towards customers, vendors, hub agents and our staff. Abuse, threats, discrimination and harassment are not tolerated, and will end your access to the platform.

You must not carry out a delivery while under the influence of alcohol or drugs.

You must not contact a customer for any purpose other than completing their delivery, and you must not keep or use their details afterwards.

7. Ratings and account status

Customers may rate a delivery. Ratings and completion history are used to allocate work and to identify where support or training would help. Persistently poor performance, repeated cancellations after acceptance, or a serious single incident may lead to suspension or removal.

Where we suspend or remove your account, we will tell you why, and you may respond. Where the reason is a safety matter, a suspension may take effect immediately.

8. Insurance and liability

You are responsible for holding valid insurance covering your vehicle and the carriage of goods. Surplus GY does not insure your vehicle and does not insure you personally.

We are responsible to you for loss we cause by failing to meet these terms, but we are not responsible for loss that was not foreseeable, for loss of profit or opportunity, or for anything caused by your own breach of these terms or of the law. Nothing here limits liability that cannot lawfully be limited.

9. Your data

How we handle your personal information, including the documents you upload and the location data collected while you work, is set out in our Privacy Policy. You may ask for a copy of your data, ask us to correct it, or delete your account from within the app.

10. Ending the arrangement

You may stop driving at any time and may delete your account from within the app. We may end your access where you break these terms, where a required document lapses, or where we stop operating the service. Ending the arrangement does not affect payment already earned for completed jobs.

11. Changes

We may update these terms, for example when rates, job types or legal requirements change. Where a change materially affects you, we will tell you through the app before it takes effect, and continuing to accept jobs afterwards means you accept the updated terms.

12. Law

These terms are governed by the laws of Guyana, and the courts of Guyana have jurisdiction over any dispute arising from them.

These terms are provided in good faith for the operation of the platform. They have not been reviewed by a lawyer qualified in Guyana, and should be checked by counsel before being relied on in a dispute.
